This form compiles all personal details of the buyer and seller of Rose Hills cemetery property.
An electronic version of the Transfer of Ownership Agreement form must be printed and submitted to the Title Administration Department. Note that the State of California requires that the spouse of a seller sign the transfer documents even if that person is not the owner, because a spouse has a right to ownership of the interment right.

Frequently Asked Questions (FAQs)
Required Fees
Fees, payable to Rose Hills, are to be paid by the new owner at the current rate when the completed transfer is submitted for processing. Fees may be subject to change without notice. Quoted fees at the time of inquiry are not guaranteed to be the same at the time a transfer is submitted for processing. Rose Hills will refuse any transfers if fees are not paid in full or missing any documentation. Personal checks are not accepted.
Property Transfer Processing Fee
All property Transfers require a $400 transaction fee. At the time of payment, a contract will be drawn up for the fees paid, to be signed by the new owner/payer of the fees.
Endowment Care Fee
In addition, an endowment care fund contribution will be charged on all property transfers to ensure adequate reserves for the ongoing care and maintenance of the cemetery. This fee will vary depending on the last endowment care fee paid to Rose Hills and what the current endowment care rate is at the time a transfer is submitted for processing. Contact the Title Administration Department at (562) 463-4563 to determine the required fees to transfer your property.

Required Documents
Rose Hills will not process the Transfer Agreement unless all required documents, information, signatures (notarized or witnessed) and fees are submitted. All information must be clear and legible for Transfer Agreement processing. White-out or cross-outs are unacceptable.
All current owners and their spouses or state-registered domestic partners (*SRDP), even if not listed on current ownership certificate, must sign and be notarized by a notary public or witnessed by a Rose Hills Title Admin. Dept. representative.
Required documents may include:
1. Death Certificates for any deceased property owners not interred at Rose Hills. If a deceased property owner is interred at Rose Hills, please indicate his/her interment location (grave #, lawn name, etc.) in Section C of the Transfer of Ownership Agreement. If all property owners are deceased, do not use the Transfer of Ownership Agreement Form. Call 562-463-4563 for further instruction.
2. Power of Attorney -- If you are signing transfer documentation on behalf of a living owner, a power of attorney will be required. The document must be a General or Durable POA that states the POA has power over the Personal/Real Estate property. If the documents are not specific, call 562-463-4563 for further instruction.
3. Original Certificate of Ownership (if the original certificate is lost, please indicate so in Section B of the Transfer Agreement).
4. Final Dissolution papers, Court Orders, and Conservatorship documents. Documents must be specific to Rose Hills Memorial Park and must include the description of the cemetery property.
5. Trust or Will – because interment rights are not considered personal property or real estate, and if all property owners are deceased and we’re determining heirship, then the property that is being bequeathed must be specifically described in the will or trust. (i.e. Grave(s) 1 and 2, Lot 287, Evergreen Garden at Rose Hills Memorial Park in Whittier California).
6. Passport – A valid (not expired) passport will be accepted as identification for a buyer for a Transfer, Affidavit of Heirs, or a Designation Order.
7. Name Change Documents –
These documents are acceptable proof of a name change, along with government-issued photo ID.
- Naturalization document, with Petition for Name Change form
- Final Dissolution Papers, if divorced
- Marriage Certificate
- Court Documents
8. Corporation Documents –
To transfer property to or from a non-profit organization, the following information (generated by the State of California) is required:
- Statement of Information
- Articles of Incorporation

Resale Information
Current owners, and their heirs, if all owners are deceased, have a right to sell their interment rights.
Rose Hills does not:
- assist owners in selling interment rights (property).
- maintain a price list for interment rights (property) that have been previously sold.
- estimate the price of any interment right (property) that has been previously sold.
- disclose details of private third-party transactions.
Restrictions
If all property owners are deceased, the California Health and Safety Code may prohibit resale of the property. To see if your property is transferable, call 562-463-4563.
10 Grave Policy – If you are a current owner and own or have owned 10 graves or more, you or anyone in your household (same address) will not be allowed to receive more property. If you are planning on transferring out rights you are only allowed to transfer up to 10 graves by yourself, after which you will need the assistance of a Cemetery Broker to continue transferring any more spaces.

The plan provides space-for-space exchange (i.e., lot-for-lot, crypt-for-crypt, niche-for-niche) of comparable interment rights after the contract is paid in full (restrictions apply). The exchange must be with a participating, affiliated cemetery and is valid only if the purchaser moves their permanent residence more than 75 miles from the original cemetery. To use this benefit, contact the new affiliated cemetery to determine your eligibility.
Rose Hills does not establish or maintain a list price for our sold out gardens. You and the person who wishes to buy your property determine today’s price. The actual price is “market driven.”
If you are the title holder/contract signer and would like to receive a copy of your contract and/or a Duplicate Certificate of your Rose Hills cemetery property; please send your request in writing along with a check for $5, per document requested, made out to Rose Hills to Rose Hills Memorial Park, Attention Title Administration Dept., at 3888 Workman Mill Rd, Whittier, CA, 90601.

Can I name a beneficiary for my interment rights?
There are no beneficiaries for cemetery property. Per the California Health and Safety Code interment right(s) are to be inherited. For more information, please call 562-463-4563.
I have only one name on the title, will my spouse or children automatically become the owner(s) after my death?
Per the California Health and Safety Code, if the interment rights are not specifically bequeathed by your will, your heirs at law would inherit the right to use the interment right(s). To become an owner or owners of the interment right(s) they would need to complete an Affidavit of Heirs document and pay the required fees. That form is not on the Rose Hills website, please call the Title Administration Dept. at 562-463-4563.
Can I have multiple Interments in one space?
You may pay to increase your interment rights to Double Depth (two caskets) or Double Interment (two cremains or 1 regular burial and 1 set of cremains). To determine eligibility, you would contact the Sales Dept. at 800-328-7526.
Why are there fees if I am transferring to a family member?
Any change in title requires that a transfer be completed with its required fees. Even if it is family members that are being added or removed.
